Terms of Service

These Terms of Service ("Terms") govern your use of the BallBrain mobile application and related services (the "App") operated by BallBrain ("BallBrain," "we," "our," or "us").

1. Acceptance and Eligibility

By creating an account or using the App, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the App.

You must be at least 13 years old to create an athlete account. If you are under the age of legal majority where you live, you represent that a parent or legal guardian has reviewed and permitted your use of the App where required. A parent or guardian who permits a minor to use the App is responsible for the minor's use.

If you use the App on behalf of a team, club, school, company, or other organization, you represent that you have authority to bind that organization and to manage athlete information as described in these Terms.

2. The BallBrain Service

The App may provide:

• AI-generated basketball training plans and exercise substitutions
• Nutrition targets and general nutrition guidance
• Workout scheduling, completion tracking, and progress history
• Vertical-jump measurement using an on-device camera and pose-estimation feature, or manual entry
• Points, streaks, quests, badges, achievements, and leaderboards
• Team rosters, athlete views, and training-plan management
• Push notifications and reminders
• Optional in-app product-feedback or product-market-fit surveys
• Exercise demonstration videos and tools for sharing achievements outside the App

Features may change, be unavailable in some locations or on some devices, or require permissions and internet access. We do not guarantee that every feature will always be available.

3. Accounts and Team Access

You agree to provide accurate, current information and keep it updated. You are responsible for protecting your credentials and for activity under your account. Notify us at hello@ballbrain.app if you suspect unauthorized access. You may not share credentials, create an account for someone without authority, impersonate another person, or circumvent age or access restrictions.

A team administrator may add an existing athlete by email. Team membership can allow authorized team personnel to view athlete profile, plan, progress, and performance information and to modify an athlete's training plan. Team administrators must:

• Have authority and any consent required to add and manage each athlete, including minors
• Use athlete information only for legitimate team and coaching purposes
• Limit access to authorized personnel and protect account and athlete information
• Promptly remove access when it is no longer needed

Athletes should only accept or remain in a team they recognize and trust.

4. Health, Safety, and Nutrition Disclaimer

IMPORTANT: BALLBRAIN IS NOT A MEDICAL DEVICE OR HEALTHCARE PROVIDER. The App provides automated fitness and nutrition information for general educational and informational purposes only. It does not provide medical advice, diagnosis, treatment, physical therapy, emergency monitoring, or a substitute for a qualified professional.

Before starting or changing exercise or nutrition activity, consult an appropriate healthcare professional, particularly if you are injured, pregnant, have a medical condition, take medication, have an eating disorder or related concern, or are unsure whether an activity is safe. Do not rely on the App to assess an injury. Stop immediately and seek appropriate help if you experience pain, faintness, dizziness, chest pain, shortness of breath, or other concerning symptoms.

You are responsible for:

• Choosing a safe area, suitable equipment, appropriate supervision, and an activity level appropriate for you
• Checking generated exercises and substitutions before performing them
• Entering accurate profile, injury, pain, and performance information
• Using a spotter or qualified coach where appropriate

Nutrition targets are estimates and may not account for allergies, medical dietary needs, pregnancy, medication, or individual metabolism. Individual results vary, and we do not guarantee any fitness, nutrition, athletic, or vertical-jump outcome.

5. AI-Generated Information

Training plans and exercise substitutions may be generated by artificial intelligence using information you provide. AI output can be incomplete, inaccurate, unsuitable, or repetitive. It must be reviewed using your own judgment and, where appropriate, by a qualified coach or healthcare professional.

Do not enter information into free-text or support fields that you do not want processed to provide the service. You may not use AI-generated output to make medical decisions or as the sole basis for high-risk decisions about another person.

6. Camera-Based Vertical-Jump Feature

The vertical-jump feature provides an estimate based on camera framing, entered height, pose detection, and other technical factors. Results and confidence scores may be inaccurate and must not be treated as certified measurements, medical assessments, scouting guarantees, or safety evaluations.

Use the feature only in a clear, safe space with the device securely positioned. You are responsible for obtaining permission from anyone captured by your camera and must not use the feature to record another person without their knowledge and authorization.

7. Acceptable Use

You may not:

• Use the App unlawfully, fraudulently, or to harm, harass, exploit, or endanger anyone
• Infringe privacy, publicity, intellectual-property, or other rights
• Upload malicious code or interfere with the App, accounts, networks, or security controls
• Scrape, harvest, reverse engineer, probe, or attempt unauthorized access except where law expressly permits it
• Manipulate leaderboards, points, measurements, or account eligibility
• Use another user's information outside the purposes for which access was provided
• Add an athlete to a team without appropriate authority or required consent
• Resell, sublicense, or commercially exploit the App or its output without written permission
• Use the App or its output to develop or train a competing product or model

We may investigate suspected misuse and remove content, restrict features, or suspend accounts where reasonably necessary to protect the service or others.

8. Content and Sharing

You retain ownership of profile images and sharing content you provide or create ("User Content"). You grant BallBrain a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and transmit User Content only as reasonably needed to operate, secure, and improve the App. This license ends when the content is deleted from our systems, subject to reasonable backup and legal retention.

You represent that you have all rights and permissions needed for User Content and that it does not violate law or another person's rights. When you share content to Instagram or another destination, that service's terms apply and you control the final post.

9. Intellectual Property and Feedback

The App, branding, software, designs, and BallBrain-provided content are owned by BallBrain or its licensors and protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.

Exercise names and third-party videos may belong to their respective owners. YouTube and other third-party marks are the property of their owners.

If you provide feedback—including optional in-app product-market-fit or product-feedback survey answers—you allow us to use it to operate and improve BallBrain without restriction or compensation, without identifying you publicly unless you agree. Survey participation is optional.

10. Third-Party Services

The App relies on services such as Firebase, DeepSeek, Expo, Resend, YouTube, Instagram, and operating-system sharing tools. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, security, or conduct. Exercise videos are provided for convenience and are not endorsements or individualized instructions.

11. Fees

The current version of the App does not describe a paid subscription or in-app purchase. If we introduce paid features, we will disclose the price, billing period, renewal and cancellation terms, and any additional purchase terms before charging you. App-store billing and refund rules may also apply.

12. Suspension, Termination, and Account Deletion

You may stop using the App at any time and may delete an athlete account through Settings. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, misuse another user's data, or if necessary to protect the App or others. Where appropriate, we will provide notice and an opportunity to appeal or correct the issue.

After termination, your right to use the App ends. Sections that by their nature should survive—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." BALLBRAIN DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLBRAIN AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM THE APP.

BALLBRAIN IS NOT LIABLE FOR INJURY OR LOSS CAUSED BY DISREGARDING SAFETY INSTRUCTIONS, PROVIDING INACCURATE INFORMATION, OR RELYING ON AUTOMATED OUTPUT IN PLACE OF PROFESSIONAL ADVICE. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

15. Indemnity

To the extent permitted by law, if you use the App on behalf of an organization or as a team administrator, you will indemnify and hold BallBrain harmless from third-party claims arising from your unauthorized addition or management of athletes, misuse of athlete information, User Content, or material breach of these Terms. This section does not apply where prohibited by consumer law.

16. Governing Law and Disputes

These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Courts with jurisdiction in Kenya will have non-exclusive jurisdiction, except that applicable consumer law may allow you to bring a claim in your place of residence. Before filing a claim, contact us and allow 30 days for an informal attempt to resolve the dispute.

17. Changes

We may update these Terms to reflect changes to the App, law, or security needs. We will post the updated Terms, change the date above, and provide additional notice of material changes when required. Changes apply prospectively. If you do not agree to updated Terms, stop using the App and delete your account.

18. General

If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, financing, or sale of the service. These Terms and the Privacy Policy form the agreement between you and BallBrain regarding the App.
