BallBrain is a fitness and nutrition application that provides:

• Social features for sharing achievements
• Leaderboards and gamification

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Security

• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized account access

4. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Post false, misleading, or defamatory content
• Impersonate any person or entity
• Interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to the App or its systems

5. Health and Fitness Disclaimer

IMPORTANT: The App provides fitness and nutrition information for educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

• Consult with a healthcare provider before starting any exercise or diet program
• Stop exercising immediately if you experience pain, dizziness, or discomfort
• The App is not responsible for any injuries or health issues that may result from using the provided plans
• Individual results may vary
• We do not guarantee specific fitness or health outcomes

6. User Content

6.1 Content Ownership

You retain ownership of content you post ("User Content"), but grant us a license to:

• Use, display, and distribute your User Content within the App
• Modify your User Content as necessary to provide services

6.2 Content Responsibility

• You are solely responsible for your User Content
• You represent that you have the right to post your User Content
• We reserve the right to remove any User Content that violates these Terms

7. Intellectual Property

• The App and its original content are owned by BallBrain
• You may not copy, modify, distribute, or create derivative works without our permission
• All trademarks and logos are the property of their respective owners

8. Subscription and Payments

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLBRAIN SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, DATA, OR USE
• PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM USE OF THE APP

13. Indemnification

You agree to indemnify and hold harmless BallBrain from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes. Continued use of the App after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
